Sales tax and income tax on equipment in New Jersey

Sales tax on equipmentA flat 6.625 percent statewide, halved in Urban Enterprise Zones and Salem County. Machinery used directly and primarily in manufacturing is exempt with an ST-4 certificate. Farm equipment is exempt with an ST-7.
Trucks and trailersTrucks, tractors, and semitrailers registered in New Jersey with a gross vehicle weight rating over 26,000 pounds are exempt from sales tax, including parts. So are vehicles operated exclusively in interstate freight under federal authority, and farm-registered vehicles over 18,000 pounds. The rating on the door sticker controls, not the registered weight.
LeasesLeases longer than six months are taxed up front on the total payments, so a lease and a loan can carry different tax at signing.
Income taxNew Jersey Gross Income Tax caps Section 179 at $25,000 and adds back all bonus depreciation for sole proprietors and pass-through owners. The Corporation Business Tax also disallows bonus depreciation. The federal deduction still applies in full on the federal return.

Questions we get

Is a new tractor really exempt from New Jersey sales tax?

If its gross vehicle weight rating is over 26,000 pounds and it is registered in New Jersey, yes, along with the trailer and parts. Give the dealer the ST-4 exemption certificate at purchase.

Why is Section 179 different on my New Jersey return?

New Jersey caps the state Section 179 deduction at $25,000 for gross income tax filers and does not allow bonus depreciation. You still take the full federal deduction. Your accountant will depreciate the difference over the normal schedule on the state return.
